END-USER LICENSE AGREEMENT (EULA)

Last updated: September 2026PLEASE READ CAREFULLYThis End-User License Agreement (“Agreement”) is a legal agreement between you (“User”, “you”) and Tiago Sá (“Licensor”, “we”, “us”) regarding your use of official Cozy Watch application binaries, installers, and related official services (“App”).By installing or using an official App distribution, you agree to this Agreement. The Cozy Watch source code is available under the MIT License. This Agreement does not limit rights granted by the MIT License or any other applicable open-source license.

1. LICENSE GRANT

Subject to this Agreement, the Licensor grants you a non-exclusive license to install and use an official App distribution on compatible devices for personal or internal business purposes. Source code covered by the MIT License may be used, copied, modified, distributed, and sold according to that license.

2. FREE AND PAID USE

2.1 Free Access: An official App distribution may offer limited functionality in its free version.
2.2 Paid Plans: Access to additional or premium features may require a paid subscription or license.
2.3 Account and Authentication: The App may require you to log in with a GitHub account to operate. You are responsible for maintaining the security of your account credentials.
2.4 Acceptance: By using the App (free or paid), you acknowledge that you have read, understood, and agreed to this EULA.

3. OWNERSHIP

The Cozy Watch name, logos, icons, artwork, and other brand assets remain subject to their applicable trademark and copyright rights. Copyright in source code is governed by the MIT License and other applicable open-source licenses. This Agreement does not grant permission to use the Cozy Watch marks in a way that suggests endorsement of a modified or redistributed build.

4. UPDATES

We may provide updates, improvements, or bug fixes at our discretion. Some updates may be installed automatically. The Licensor is not obligated to provide support, maintenance, or future updates.

5. USE RESTRICTIONS

You may not remove required copyright or license notices from an official distribution, misrepresent a modified build as an official Cozy Watch release, use the Cozy Watch marks in a confusing way, use the App unlawfully, or bypass paid functionality in an official distribution. Nothing in this section restricts rights granted by the MIT License.

6. DATA AND THIRD-PARTY SERVICES

The App connects to GitHub’s API to display and manage pull-request information. Use of the App is also subject to GitHub’s Terms of Service and Privacy Policy. We do not store your GitHub credentials; authentication tokens are securely stored on your device using encryption. By using the App, you agree to this limited interaction with GitHub’s services.

7. WARRANTY DISCLAIMER

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE LICENSOR DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM THE USE OR INABILITY TO USE THE APP.

9. TERMINATION

This Agreement is effective until terminated. If you breach it, your permission to use an official distribution may end. Termination does not revoke rights granted under the MIT License. You must stop using affected official services and remove an official distribution if required by law.

10. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict-of-law principles. Any disputes shall be submitted to the exclusive jurisdiction of the courts located in Portugal.

11. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between you and the Licensor with respect to the App and supersedes all prior or contemporaneous understandings.

All third-party components are licensed under their respective open-source licenses. Their terms apply in addition to this EULA.
Open-source components are governed by their respective licenses. Where this Agreement conflicts with an applicable open-source license, the open-source license controls for the covered code.
